§ 6-22. Hours for sale.

  • (a)

    Class "B" retail intoxicating liquor or fermented malt beverage licensed premises.

    (1)

    No holder of a retail Class "B" alcohol beverage license shall be permitted to remain open between the hours of 2:00 a.m. and 6:00 a.m. except as provided in this subsection and subsection (c). On Saturday and Sunday, the closing hours shall be between 2:30 a.m. and 6:00 a.m. On January 1, the premises operating under a Class "B" license are not required to close.

    (2)

    Between 12:00 midnight and 6:00 a.m. no person may sell alcohol beverages in Class "B" licensed premises in an original unopened package, container or bottle or for consumption away from the premises.

    (b)

    Class "A" retail intoxicating liquor or fermented malt beverage licensed premises.

    (1)

    Between 12:00 midnight and 6:00 a.m., no person may sell fermented malt beverages on Class "A" licensed premises.

    (2)

    No premises for which a retail Class "A" intoxicating liquor license has been issued shall be permitted to remain open for the sale of liquor between 9:00 p.m. and 6:00 a.m.

    (c)

    Hotels, restaurants, bowling alleys and golf courses; excepted. Hotels and restaurants whose principal business is the furnishing of food or lodging to patrons, and bowling alleys and golf courses shall be permitted to remain open for the conduct of their regular business but shall not be permitted to sell alcohol beverages during the hours mentioned in this section of the Code.
