§ 38-4. Procedure for filling vacancy and eligibility for chief of police.

  • (a)

    Eligibility for chief of police. The following are requirements for appointment to the position of chief of police. The requirements are minimum requirements, and the board may impose additional requirements as it deems necessary.

    (1)

    The appointee shall have actively served in the law enforcement field a minimum of five years prior to appointment.

    (2)

    The appointee shall have obtained at least a high school diploma.

    (3)

    The appointee shall be of highest integrity and character.

    (b)

    Procedures for appointment of chief of police. Upon a vacancy occurring in the position of chief of police:

    (1)

    The board shall publish notice of such vacancy in those newspapers and law enforcement journals as it deems necessary. This requirement may, however, be waived.

    (2)

    The board shall refer the matter to the protection committee for review and recommendation.

    (3)

    The protection committee shall conduct oral interviews with each applicant. The committee may solicit written advice and recommendations from previous employers and any other agency that may be applicable. In addition to submitting the name of the recommended applicant to the board for its consideration, the protection committee shall also submit to the board the names of all other applicants for the position.

    (4)

    The board shall review the report and recommendation of the protection committee and shall make such other investigation as it deems necessary.

    (5)

    The president shall thereafter make the appointment, subject to confirmation by the board.
