§ 10-1. Farm animals.

  • (a)

    Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection, except where the context clearly indicates a different meaning:

    Domestic animals means only dogs and cats.

    Farm animals means all animals except domestic animals.

    (b)

    Penalty. Any person found in violation of this section shall be subject to section 1-11. The enforcement of this section may also be pursued by an injunction proceeding in a court of record.

    (c)

    Farm animals prohibited. No person shall house, quarter, pasture, store or feed any farm animal within the village limits, except as provided by the village zoning ordinance, or as provided in subsection (d) of this section.

    (d)

    Exemptions from prohibition.

    (1)

    Horse-drawn carriage and sleigh rides exempt. The provisions of this section shall not apply to horse-drawn carriages or sleigh rides nor to the housing, quartering, storing or feeding of such horses used for carriage or sleigh rides, but they shall be subject to the approval by the board and regulated by such conditions as the board may deem necessary and proper; and such approval by the board shall be subject to annual review and annual renewal of any such board approval. Additional or different conditions may be imposed by the board at the time of each annual review.

    (2)

    Public display of animals. Notwithstanding the provisions of this section, the board may permit the temporary housing, quartering, storing or feeding of animals which are part of a bona fide circus, or convention, or such other activity or event where animals are on display for public viewing. The board, in considering such permit, shall determine that:

    a.

    The type of animals will not likely present a danger to the health, safety or welfare of the public. The board may seek the recommendation and advice of the police chief.

    b.

    Adequate sanitation and waste disposal measures will be undertaken by the sponsor of the activity. Such sanitation measures shall be reviewed by the environmental committee.

    c.

    The facilities housing the animals are humane and not detrimental to the well-being of the animals. The board may, at the expense of the sponsor, seek the opinion of a duly licensed veterinarian or duly authorized humane officer.

    d.

    The sponsor and the owner provide adequate public liability insurance coverage in an amount and kind satisfactory to the board. Such policy shall also name the board and its officers, agents and employes, as named insureds. A certificate of such insurance shall be filed with the clerk before any permit approved under this subsection is issued to the sponsor.

    e.

    Any permit issued under this subsection shall specifically identify the location of the animals and the time period in which the animals will be allowed to remain within the village. The board may revoke any permit issued under this subsection, if it determines that any conditions specified in the permit are being violated.
